§ 4.28.189. Penalties.

  • A.

    The penalty for not obtaining a solicitation license by any non-exempt person or entity sponsoring or promoting charitable or commercial solicitation activities in the village shall be as set forth in Section 4.04.150 of the Village Code.

    B.

    In addition to and without limitation on any other penalties or remedies provided in this chapter, the penalty for not obtaining a collection box license prior to placing a collection box or collection box(es) on private property within the village shall be as set forth in Section 4.04.150 of the Village Code. A separate offense shall be deemed committed by the operator and site host on each day on which a violation occurs or continues to exist.

    C.

    Joint and Several Liability. The (i) operator and (ii) a site host who knowingly allows a collection box to remain on his, her or its property in violation of Chapter 4.28 shall be jointly and severally liable for any violation of Chapter 4.28.

    D.

    Upon violation of any other provision of this article, a first offense shall be punishable by a fine not to exceed one hundred dollars ($100.00).

    E.

    Upon violation of any other provision of this article, a second offense shall be punishable by a fine not to exceed two hundred dollars ($250.00).

    F.

    Upon violation of any other provision of this article, a third or subsequent offense shall be punishable by a fine not to exceed seven hundred fifty dollars ($750.00).

    G.

    In addition to the monetary penalties listed herein, upon being found liable by an administrative adjudication hearing officer, the violator may have his or her solicitation registration certificate and safety banned suspended, revoked, or be banned from soliciting within the village prospectively for up to one year and shall be barred from receiving a collection box license for a period of two years from the date of violation(s).
